The Data We Collect
We collect a variety of data that you provide directly and indirectly to us. We process your data when necessary to provide you with the Software that you have requested when accepting our End User License Agreement, or where we have obtained your prior consent, or where we have a legitimate interest to do so. For example, we may have a legitimate interest to process your data for security, testing, maintenance, and enhancement purposes of the Software we provide to you, or for analytics, research, and reporting purposes. Without your data, we cannot provide you with the Software you have requested or you may be limited in your use of the Software.
Data You Provide to Us
RiseML collects data from you through:
- Account and product registration and administration of your account
- The RiseML Software that you use
- Requests or questions you submit to us via forms or email (e.g., support forms, sales forms, user research participation forms)
- Your communications and dealings with us
- Your participation in RiseML sweepstakes, contests, or research studies
- Uploads or posts to the Software
- Requests for customer support and technical assistance
Data from and about you. The types of data we collect will depend upon the Software you use, how you use them, and what you choose to provide. The types of data we collect directly from you may include:
- Name, email address, and account type
- Log-in details and password, if you create a RiseML account
- Any email requests or questions you submit to us
Data we collect automatically. When you use our Software including, but not limited to, when you access the Software via our websites, your mobile devices, and RiseML software/applications, we automatically collect certain data as described in this Section. As discussed further below, we and our service providers (which are third-party companies that work on our behalf to provide and enhance the Software) use a variety of technologies, including cookies and similar tools, to assist in collecting this data.
Website Data. We collect data about how you use our website to understand how you use it. This may include data such as your web request, Internet Protocol (“IP”) address, browser type and settings, referring / exit pages and URLs, number of clicks and how you interact with links, metadata associated with uploaded Content, domain names, landing pages, pages viewed, mobile carrier, date and time stamp, and other such data.
Node Identifiers. When you use the Software, we collect specific data about the hardware running RiseML (“Node”), including data about the node and other unique node identifiers. We also collect data such as the type of node you are using, its hostname, the hardware capacities of the node (eg., CPUs, GPUs, memory), the software running on the node, including but not limited to the operating system, Docker, kernel, Nvidia driver, and kublet versions, the role of each device, and their status. We also continue to collect data about the version of Kubernetes and RiseML currently running on the node, including, but not limited to, software revisions, build dates, account keys, and cluster IDs. We may associate these node identifier with your account and will use data associated with your node identifier to customize our Software to your node and to analyze any node-related issues.
Log Files. When you use the Software, our servers automatically record certain data in server logs. To keep our Software running, for each experiment, we collect the username, project name, configuration, and current state.
Error Files. Use of our Software may also entail errors. To help remediate these potential problems and provide you a better Software, we collect data about errors. For each error, we collect data including, but not limited to, the cluster ID, stacktrace and exception message, time, hostname, context information, process ID, and framework/programming language. We may associate these error logs with your account and will use data associated with your error logs to improve our Software to you and to analyze any Software related issues.
Data we collect from third-party integrations. If you choose to use third-party integrations through the Software or are required to do so by a Customer, such providers may allow us and our service providers to have access to and store additional information about your interaction with those services and platforms as it related to use of the Software. If you do not wish to have this information shared, do not initiate these connections.
Data We Collect from Affiliates and Non-Affiliated Third Parties. RiseML may receive additional information about you from affiliates under common ownership and control, and from third parties, such as business partners, marketers, researchers, analysts, and other parties that we may use to supplement the data that we collect directly from you.
Collection of Data Across Devices. Sometimes, we may use the data we collect, for instance, username, to locate or try to locate the same unique users across multiple connections or devices, or work with service providers that do this, in order to save your preferences across devices and analyze usage of the Software.
Cookies and Similar Technologies
To collect the data in the “Data we collect automatically” section above, we and our service providers use Internet server logs, cookies, tags, tracking pixels, and other similar tracking technologies. A web server log is a file where website activity is stored. A cookie is a small text file that is placed on your computer or mobile device when you visit a site, that enables us to: (i) recognize your computer and login session; (ii) store your preferences and settings; (iii) understand which web pages of the Software you have visited; (iv), enhance your user experience by delivering and measuring the effectiveness of content and advertising tailored to your interests; (v) perform analytics; and (vi) assist with security and administrative functions. Tracking pixels (sometimes referred to as web beacons or clear GIFs) are tiny electronic tags with a unique identifier embedded in websites, online ads and/or email, and that are designed to provide usage data like ad impressions or clicks, email open rates, measure popularity of the Software and associated advertising, and to access user cookies. As we adopt additional technologies, we may also gather data through other methods.

How We Use Your Data

- Respond to your request for information and provide you with more effective and efficient customer service
- Provide you with product updates and information about products you have purchased from us
- Provide you with Software notifications via email and other means of contact
- Contact you by email, postal mail, Slack, or phone regarding RiseML and third-party products, services, surveys, research studies, promotions, special events and other subjects that we think may be of interest to you
- Help us better understand your interests and needs, and improve the Software
- Synthesize and derive insights from your use of different RiseML products and Software
- Engage in analysis, research, and reports regarding use of our Software
- Provide, manage, and improve the Software
- Protect our Software and our users
- Understand and resolve Software crashes and other issues being reported
You consent that, for the purposes discussed in this Policy, we may combine the data that we collect through the Software with data that we receive from other sources, both online and offline, and use such combined data in accordance with this Policy.
We may aggregate and/or de-identify data collected through the Software so that such data can no longer be linked to you or your device (“Aggregate/De-Identified Data”). We may use Aggregate/De-Identified Data for any purpose, including without limitation for research and marketing purposes, and may also share such data with any third parties, including advertisers, promotional partners, sponsors, event promoters, and/or others. By using the Software, you consent to such use.
How We Share And Disclose Your Data
RiseML will share your data in the following ways:
Software Providers. We may provide access to or share your data with select third parties who perform services on our behalf. These third parties provide a variety of services to us, including without limitation billing, sales, marketing, provision of content and features, analytics, research, customer Software, data storage, security, fraud prevention, payment processing, and legal Software.
Third-Party Integrations. When you initiate a connection with a third-party integration through the Software, we will share data about you that is required to enable your use of the third-party integration through the Software.
Safety, Legal Purposes, and Law Enforcement. We use and disclose Data as we believe necessary: (i) under applicable law, or payment method rules; (ii) to enforce our terms and conditions; (iii) to protect our rights, privacy, safety or property, and/or that of our affiliates, you or others; and (iv) to respond to requests from courts, law enforcement agencies, regulatory agencies, and other public and government authorities, which may include authorities outside your country of residence.
Aggregate/De-Identified Data. From time to time, RiseML may share Aggregate/De-Identified Data about the use of the Software, such as by publishing a report on usage trends. As stated above, this Policy places no limitations on our use or sharing of Aggregate/De-Identified Data.
Third Party Links And Services
The Software contains links to third-party sites and integrations, such as Braintree. If you choose to use these sites or integrations, you may disclose your information not just to those third-parties, but also to their users and the public more generally depending on how their services function. Because these third-party websites and services are not operated by RiseML, RiseML is not responsible for the content or practices of those sites or services. The collection, use, and disclosure of your personal and other information will be subject to the privacy policies of the third party sites or services, and not this Policy. We urge you to read the privacy and security policies of these third-parties.
If you want to learn more about the data collected through the Software, or if you would like to access or rectify your information and/or request deletion of data we collect about you, or restrict or object to the processing of your data, please contact us using the contact information below. Where you have provided consent, you may withdraw your consent at any time, without affecting the lawfulness of the processing that was carried out prior to withdrawing your consent. If you are dissatisfied with the way we process your data, you may lodge a complaint with the data protection authority (“DPA”) in your jurisdiction. If you are a resident of Germany, please see the DPA located in your particular state.
Jurisdiction And Cross-Border Transfers
How Long We Store Your Data
We will retain your data for the period necessary to fulfill the purposes outlined in this Policy unless a longer retention period is required or permitted by law. Even if you close your account, we will retain certain data to meet our obligations. There may also be residual Data that will remain within our databases and other records, which will not be removed.
We reserve the right to amend this Policy at any time to reflect changes in the law, our data collection and use practices, the features of our Software, or advances in technology. We will make the revised Policy accessible through the Software, so you should review the Policy periodically. If we make a material change to the Policy, you will be provided with appropriate notice and we will seek your consent to the updated Policy in accordance with legal requirements.
We use reasonable organizational, technical and administrative measures to protect personal data within our organization against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access. Unfortunately, no method of transmission over the Internet, and no means of electronic or physical storage is absolutely secure, and thus we cannot ensure or warrant the security of that data. If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of your account has been compromised), please contact us, as listed below, immediately.
